The Fair Labor Standards Act (FSLA) and certain New York wage and hour laws ensure that workers are paid fairly. Under the law, most employees must be paid overtime compensation for any hours worked in excess of 40 hours per week. Employees also must be provided with meal breaks and rest periods. Only employees classified by the government as administrative, executive or professional are “exempt” from these rules.
Some employers illegally misclassify employees as administrative, executive or professional to avoid paying overtime. Receiving a salary does not automatically make an employee “exempt” from overtime and meal breaks. The determination of "exempt" or "non-exempt" status is not always as clear as your employer would like you to believe. As your job title does not determine whether you are “exempt” from overtime compensation. Exemptions are based upon the specific duties you perform.
